We recommend speaking to an experienced property professional, such as a letting agent, solicitor or a High Court Enforcement Officer who is familiar with the application and enforcement process, to see if transferring up is the right option for you.
If it is, you can apply for leave to transfer the possession to the High Court for enforcement at the same time as you request an Order for Possession. This will save you time and money later on in the process.
You can apply for an Order for Possession through the HM Courts and Tribunals Possession Claim Online service, and we would also suggest that you read the Government’s advice about the application process before commencing the eviction of tenants at Evicting tenants in England: Possession hearings and orders - GOV.UK
If you also apply to transfer up at this point, you must give good reasons explaining why you want to do so. Our Guide to Transferring Up sets out an approach you can take.
